Vous le savez\u00a0: la dur\u00e9e d\u2019un bail commercial ne peut \u00eatre inf\u00e9rieure \u00e0 9\u00a0ans. Toutefois, par d\u00e9rogation, le propri\u00e9taire peut, \u00e0 l\u2019expiration d\u2019une p\u00e9riode de 3\u00a0ans, donner cong\u00e9 au locataire pour construire, reconstruire ou sur\u00e9lever l\u2019immeuble. Il peut \u00e9galement, toujours \u00e0 l\u2019issue d\u2019une p\u00e9riode triennale, reprendre le local d\u2019habitation lou\u00e9 accessoirement au local commercial pour le r\u00e9affecter \u00e0 un usage d\u2019habitation si tel n\u2019\u00e9tait pas le cas, ou encore pour ex\u00e9cuter des travaux prescrits ou autoris\u00e9s dans le cadre d\u2019une op\u00e9ration de restauration immobili\u00e8re.<\/p>\n

Une loi r\u00e9cente (dite \u00ab\u00a0loi Elan\u00a0\u00bb) introduit un nouveau cas de reprise triennale. D\u00e9sormais (depuis le 25\u00a0novembre dernier), le bailleur est autoris\u00e9 \u00e0 mettre fin au bail pour transformer, par reconstruction, r\u00e9novation ou r\u00e9habilitation, le local commercial en local \u00e0 usage principal d\u2019habitation.<\/p>\n

\n Rappel :<\/span> le cong\u00e9 doit \u00eatre envoy\u00e9 par le bailleur au moins 6\u00a0mois \u00e0 l\u2019avance par acte d\u2019huissier de justice.<\/p>\n
