L\u2019employeur qui organise des \u00e9lections pour mettre en place ou renouveler le comit\u00e9 social et \u00e9conomique\u00a0(CSE) doit inviter les syndicats \u00e0 n\u00e9gocier le protocole d\u2019accord pr\u00e9\u00e9lectoral.<\/p>\n

Cette invitation doit ainsi \u00eatre transmise\u00a0:
– aux organisations syndicales qui satisfont aux crit\u00e8res de respect des valeurs r\u00e9publicaines et d\u2019ind\u00e9pendance, l\u00e9galement constitu\u00e9es depuis au moins\u00a02\u00a0ans et dont le champ professionnel et g\u00e9ographique couvre l\u2019entreprise ou l\u2019\u00e9tablissement concern\u00e9s\u00a0;
– \u00e0 celles reconnues repr\u00e9sentatives dans l\u2019entreprise ou l\u2019\u00e9tablissement\u00a0;
– \u00e0 celles ayant constitu\u00e9 une section syndicale dans l\u2019entreprise ou l\u2019\u00e9tablissement\u00a0;
– aux syndicats affili\u00e9s \u00e0 une organisation syndicale repr\u00e9sentative au niveau national et interprofessionnel.<\/p>\n

Cette invitation doit parvenir aux syndicats au plus tard 15\u00a0jours avant la date de la premi\u00e8re r\u00e9union de n\u00e9gociation. Et, dans le cas d\u2019un renouvellement du CSE, elle doit \u00eatre effectu\u00e9e 2\u00a0mois avant l\u2019expiration du mandat des d\u00e9l\u00e9gu\u00e9s.<\/p>\n

Un r\u00e9cent d\u00e9cret vient de d\u00e9finir les mentions que l\u2019employeur doit int\u00e9grer dans l\u2019invitation \u00e0 n\u00e9gocier le protocole d\u2019accord pr\u00e9\u00e9lectoral. Ainsi, ce document doit indiquer au moins\u00a0:
– le nom et l\u2019adresse de l\u2019employeur, ainsi que, le cas \u00e9ch\u00e9ant, la d\u00e9signation de l\u2019\u00e9tablissement\u00a0;
– l\u2019intitul\u00e9 et l\u2019identifiant de la convention collective de branche applicable, le cas \u00e9ch\u00e9ant\u00a0;
– le lieu, la date et l\u2019heure de la premi\u00e8re r\u00e9union.<\/p>\n

\n Rappel :<\/span> dans les entreprises comptant entre\u00a011 et 20\u00a0salari\u00e9s, l\u2019employeur n\u2019est pas contraint d\u2019inviter les organisations syndicales \u00e0 n\u00e9gocier le protocole d\u2019accord pr\u00e9\u00e9lectoral en l\u2019absence de candidature salari\u00e9e dans les 30\u00a0jours suivant l\u2019information donn\u00e9e par l\u2019employeur sur l\u2019organisation des \u00e9lections du CSE.<\/p>\n
