Le locataire commercial est tenu d\u2019utiliser le local lou\u00e9 conform\u00e9ment \u00e0 la \u00ab\u00a0destination\u00a0\u00bb pr\u00e9vue par le bail. Autrement dit, il ne peut y exercer que la ou les activit\u00e9s pr\u00e9vues dans le bail, ainsi que celles consid\u00e9r\u00e9es comme y \u00e9tant implicitement incluses. \u00c0 d\u00e9faut, le bailleur serait en droit de demander en justice la r\u00e9siliation du bail.<\/p>\n

Ainsi, dans une affaire r\u00e9cente, un bail commercial pr\u00e9voyait que les locaux lou\u00e9s \u00e9taient exclusivement destin\u00e9s \u00e0 usage d\u2019h\u00f4tel de tourisme et toutes activit\u00e9s accessoires. Or, la soci\u00e9t\u00e9 locataire avait, pendant quelques mois, exerc\u00e9 dans ces locaux une activit\u00e9 de restauration, accessible \u00e0 une client\u00e8le ext\u00e9rieure \u00e0 l\u2019h\u00f4tel, avec publicit\u00e9 en ligne et entr\u00e9e par une porte distincte de celle de l\u2019entr\u00e9e de l\u2019h\u00f4tel. Elle avait m\u00eame par la suite modifi\u00e9 l\u2019acc\u00e8s au local et cherch\u00e9 \u00e0 att\u00e9nuer la visibilit\u00e9 de l\u2019activit\u00e9.<\/p>\n

Saisis par le bailleur d\u2019une action en r\u00e9siliation du bail, les juges ont consid\u00e9r\u00e9 que l\u2019activit\u00e9 de restauration exerc\u00e9e par le locataire n\u2019\u00e9tait pas comprise dans la destination contractuelle du bail car il s\u2019agissait d\u2019une v\u00e9ritable activit\u00e9 distincte de nature \u00e0 attirer une nouvelle client\u00e8le. Ils en ont d\u00e9duit que ce manquement du locataire aux obligations du bail \u00e9tait suffisamment grave pour justifier la r\u00e9siliation du bail.<\/p>\n
