Dans la mesure o\u00f9 l\u2019inflation reste encore \u00e9lev\u00e9e, les pouvoirs publics ont d\u00e9cid\u00e9 de prolonger pour une ann\u00e9e suppl\u00e9mentaire la mesure, prise l\u2019an dernier, consistant \u00e0 plafonner l\u2019augmentation des loyers des baux commerciaux \u00e0 3,5\u00a0%.<\/p>\n

\n \u00c0 noter :<\/span> les loyers des baux commerciaux sont r\u00e9vis\u00e9s, en principe, en fonction de l\u2019\u00e9volution de l\u2019indice des loyers commerciaux\u00a0(ILC). Sans cette mesure sp\u00e9cifique de plafonnement \u00e0 3,5\u00a0%, l\u2019augmentation des loyers commerciaux serait tr\u00e8s forte. Ainsi, la derni\u00e8re hausse en date de l\u2019ILC, celle du 1er<\/sup>\u00a0trimestre\u00a02023, s\u2019\u00e9tablit \u00e0 6,69\u00a0% sur un an. Et les pr\u00e9c\u00e9dentes se sont \u00e9lev\u00e9es \u00e0 6,29\u00a0% (4e<\/sup>\u00a0trimestre\u00a02022), \u00e0 5,37\u00a0% (3e<\/sup>\u00a0trimestre\u00a02022) et \u00e0 4,43\u00a0% (2e<\/sup>\u00a0trimestre\u00a02022)\u00a0!<\/p>\n

En pratique, les bailleurs pourront donc continuer d\u2019augmenter les loyers commerciaux, mais sans que cette augmentation puisse exc\u00e9der 3,5\u00a0%, et ce m\u00eame si la variation de l\u2019ILC est sup\u00e9rieure. Cette mesure s\u2019appliquera donc pendant une ann\u00e9e suppl\u00e9mentaire, soit jusqu\u2019\u00e0 la parution de l\u2019indice du 1er<\/sup>\u00a0trimestre\u00a02024.<\/p>\n

\n Attention :<\/span> cette mesure ne s\u2019applique qu\u2019aux petites et moyennes entreprises, c\u2019est-\u00e0-dire aux entreprises qui emploient moins de 250\u00a0personnes et dont le chiffre d\u2019affaires annuel n\u2019exc\u00e8de pas 50\u00a0millions d\u2019euros ou dont le total de bilan n\u2019exc\u00e8de pas 43\u00a0millions d\u2019euros.<\/p>\n

La mesure de blocage de l\u2019augmentation des loyers des baux d\u2019habitation \u00e0 3,5\u00a0% en m\u00e9tropole est \u00e9galement reconduite pour une ann\u00e9e suppl\u00e9mentaire, soit jusqu\u2019au 1er<\/sup>\u00a0trimestre\u00a02024.<\/p>\n
