Jusqu\u2019alors, un salari\u00e9 qui ne se pr\u00e9sentait plus \u00e0 son poste de travail sans justifier son absence, c\u2019est-\u00e0-dire qui abandonnait son poste de travail, ne pouvait pas \u00eatre consid\u00e9r\u00e9 comme d\u00e9missionnaire. En effet, dans une telle situation, l\u2019employeur n\u2019avait pas vraiment d\u2019autres choix, face \u00e0 un salari\u00e9 qui refusait de r\u00e9int\u00e9grer son poste, que de le licencier pour faute.<\/p>\n

Mais les r\u00e8gles vont prochainement changer\u00a0! La r\u00e9cente loi dite \u00ab\u00a0march\u00e9 du travail\u00a0\u00bb a cr\u00e9\u00e9 une pr\u00e9somption de d\u00e9mission en cas d\u2019abandon de poste d\u2019un salari\u00e9.<\/p>\n

\n \u00c0 noter\u00a0:<\/span> un d\u00e9cret doit encore venir fixer les modalit\u00e9s d\u2019application de cette mesure et donc permettre son entr\u00e9e en vigueur.<\/p>\n

Concr\u00e8tement, lorsqu\u2019un salari\u00e9 abandonnera son poste, l\u2019employeur devra le mettre en demeure de justifier son absence ou de r\u00e9int\u00e9grer son emploi dans un certain d\u00e9lai. Et ce, par lettre recommand\u00e9e avec accus\u00e9 de r\u00e9ception ou par lettre remise en main propre contre d\u00e9charge.<\/p>\n

\n Pr\u00e9cision\u00a0:<\/span> le d\u00e9lai minimal qui devra \u00eatre respect\u00e9 par l\u2019employeur sera pr\u00e9cis\u00e9 par d\u00e9cret.<\/p>\n

\u00c0 l\u2019issue du d\u00e9lai mentionn\u00e9 dans la mise en demeure, le salari\u00e9 qui n\u2019aura pas justifi\u00e9 son absence ni r\u00e9int\u00e9gr\u00e9 son poste de travail sera consid\u00e9r\u00e9 comme d\u00e9missionnaire. Et il ne pourra donc pas pr\u00e9tendre aux allocations ch\u00f4mage.<\/p>\n

\n Attention\u00a0:<\/span> le salari\u00e9 pourra contester cette d\u00e9mission devant le Conseil de prud\u2019hommes, notamment s\u2019il estime que son absence \u00e9tait justifi\u00e9e (exercice du droit de retrait, raison de sant\u00e9, manquements reproch\u00e9s \u00e0 l\u2019employeur\u2026). La d\u00e9mission pourra alors \u00eatre requalifi\u00e9e par les juges en licenciement sans cause r\u00e9elle et s\u00e9rieuse.<\/p>\n
